1. Acceptance of general sales conditions
Prior to placing an order, the customer acknowledges having read and understood the general terms and conditions of sale set out on this screen, and expressly declares his unreserved acceptance of them. The present terms and conditions of sale govern the contractual relationship between piecesbateaux.com and its customer. They will prevail over all other conditions appearing in any other document, except prior, express and written derogation by piecesbateau.com.
The present terms and conditions of sale may be modified at any time by piecesbateaux.com, without prior notice. The applicable conditions will be those in force on the site at the time of validation of the order.
2. Order
The automatic recording systems are considered as proof of the nature and content of the order. piecesbateaux.com confirms the acceptance of the order to the customer at the e-mail address provided. The sale will be concluded as of the validation by piecesbateaux.com of the payment of the order, i.e. the date of validation of the payment for orders paid online by credit card and PayPal or the date of reception of the payment by bank transfer or check. Piecesbateaux.com reserves the right to refuse or cancel any order from a customer with whom there is a dispute over payment of a previous order.
3. Price and payment
The price is expressed in Euros and includes all taxes. The price indicated on product sheets does not include transport.
The price indicated in the order confirmation is the final price, inclusive of all taxes and including VAT for France and EEC countries. The price is payable in cash on the day of order confirmation.

4. Reservation of ownership clause
By express agreement, and in accordance with the provisions of the law of May 12 1980, the products ordered remain the property of piecesbateaux.com until full payment of their price by the customer. In the event of non-performance of its obligations by the customer, whatever the cause, piecesbateaux.com will be entitled to demand the immediate return of the products at the customer's expense and risk.
5. Product availability and shipment
All lead times announced on the piecesbateaux.com website are in working days (excluding Saturdays, Sundays and public holidays). We make every effort to dispatch your items as quickly as possible.
Orders are processed after validation of payment when paid online by credit card or PayPal, or on receipt of payment when the customer has chosen to pay by bank transfer or cheque.
Products in stock are dispatched within 24 hours, excluding Saturdays, Sundays and public holidays.
Products requiring a lead time are specified on our website. Availability times are subject to change at the supplier's initiative. The availability time indicated on the product sheet does not include the time it takes for the product to reach the customer.
In the event of unavailability of products from our suppliers, piecesbateaux.com undertakes to offer the customer replacement items or to reimburse the missing items, without delay and within 15 days at the latest, in accordance with the provisions of article L121-20-3 of the French Consumer Code.
6. Limitation of liability
The information given on the site, photographs, product sheets, prices, etc. are given for information only. Piecesbateaux.com makes every effort to ensure the accuracy of the information presented on the site. Any errors that may have been introduced are fortuitous and will be rectified as soon as possible. Piecesbateaux.com cannot be held responsible for simple errors or omissions which may have occurred despite all the precautions taken in the presentation of the products. The same applies to any product modifications decided by the manufacturers.
In accordance with current legislation, piecesbateaux.com is not responsible for the non-performance or poor performance of the contract attributable either to the consumer, or to the insurmountable and unforeseeable act of a third party to the contract, or to a case of force majeure.
7. Withdrawal - Return
In accordance with the provisions of articles L.121-20 et seq. of the French Consumer Code, the customer has 14 days from the date of receipt to return the product in its original packaging.
All product returns following a right of retraction will be at the buyer's expense, and must scrupulously respect the following principles:
- be in perfect condition for resale
- Be returned in its original packaging, in perfect condition, and with all parts supplied with the product (instructions, accessories, etc.).
- Respect the return procedure described below
- The customer must complete the "Request for return" form.

Special cases:
Certain items are subject to special return or exchange conditions. These products are clearly identified on the site. For these products, acceptance of return is not systematic. The customer must guarantee that the packaging has not been opened and that the part has not been assembled. If there is any doubt about the product, the professional reserves the right to refuse the return if he considers that he cannot guarantee the product.
Furthermore, electrical or electronic parts, hydraulic components, engines and propellers cannot be returned, as they are sensitive parts linked to the boat's safety, and their warranty can no longer be guaranteed. The customer will not be able to benefit from the right of withdrawal for all specific parts offered on quotation and not present in our catalog, as these will have been specifically ordered from suppliers at the customer's express request.
In the event of retraction, or in the event of an order error on the part of the customer, the cost of return shipment shall be borne by the customer.
Returns will only be accepted if the product has not been unpacked/used. Products sold in blister packs or with labels must be returned in their original condition. Before any return of goods, the customer must fill in the "return request" form.

Returned items will be replaced or reimbursed to the customer where appropriate.
8. Disputes - Mediation
In the event of a dispute between the professional and the consumer, the two parties will endeavor to find an amicable solution. If no amicable agreement can be reached, the consumer may refer the matter free of charge to the consumer mediator to which the professional belongs, i.e. the Association of European Mediators (AME CONSO), within one year of the written complaint sent to the professional.

These terms and conditions are governed by French law. Any dispute concerning the interpretation, performance or breach of contract shall be submitted to the competent court under the conditions imposed by common law.
9. Delivery
Delivery of orders is carried out by service providers independent of piecesbateaux.com and within the deadlines announced by these service providers. The delivery times announced by these service providers are usually 48 hours for parcels under 30kg and over 72 hours for parcels over 30kg, in metropolitan France and Corsica.
Whatever the place of delivery, it is carried out within the time slot provided by our carrier by handing over the product directly to the announced recipient, or in the event of absence, to another person authorized for this purpose by the customer. In the absence of the addressee, a delivery notice will be left at the delivery address. Any costs incurred for re-delivery are to be borne by the customer. The customer is responsible for checking the condition of the products upon receipt. Any damaged parcel may be refused by the customer and automatically returned to the sender free of charge. Without this refusal by the customer, piecesbateaux.com will not be able to file a claim with the delivery services. No claim will be accepted if these formalities are not respected.
Piecesbateaux.com will, in any case, be released from its obligation to deliver in case of :
- the occurrence of a case of force majeure
- inaccuracy of delivery information provided by the customer (address, telephone number, email).
10. Warranty
10.1 Contractual warranty
The warranty granted is that of the manufacturer. The duration of the warranty depends on the type of product. It is generally for one year (12 months). However, the extent and duration of the warranty may vary from manufacturer to manufacturer and from brand to brand. The customer can consult the exact terms of the warranties on the manufacturer's website or in the product manual.
The warranty does not cover :
- Replacement of consumables (filters, turbines, seals, spark plugs, bulbs, fuses, etc.),
- Abnormal or improper use of products,
- Damage caused by the intervention of a repairer not authorized by the manufacturer,
- Damage resulting from an external cause (e.g. accident, shock, oxidation, presence of sand, etc.).
- Non-compliant use
- Defects in maintenance
Damage due to incorrect handling, incorrect connection (whether using original accessories or other accessories substituted by the customer), abusive or abnormal use, intentional or accidental physical modification, or use for professional or commercial purposes.
Spare parts or accessories whose replacement results from normal wear and tear, or from routine maintenance operations: light bulbs, batteries, seals, etc...
The cost of transporting and modifying the device, in the event of a recall by the manufacturer due to a serial defect.
Damage caused by an external event (lightning, water damage, etc.).
Interventions carried out on the device by any person not authorized by the After-Sales Service Department, as well as malfunctions and damage resulting from such intervention.

10.2 Legal warranty of conformity
The customer benefits from the legal guarantee of conformity, i.e. the guarantee that the product purchased conforms to its intended use and to the description given on the product data sheet. It applies to defects present and visible at the date of purchase or delivery of the product. The legal warranty of conformity does not apply to products that have been modified, repaired or integrated by the customer, or that are defective due to misuse by the customer.
The Customer has a period of two (2) years from the date of delivery of the goods to obtain the implementation of the legal warranty of conformity in the event of the appearance of a defect of conformity. During this period, the customer is only required to establish the existence of the lack of conformity and not the date of its appearance.
Where the contract for the sale of the good provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal warranty is applicable to this digital content or digital service throughout the period of supply provided. During this period, the Customer is only required to establish the existence of the lack of conformity affecting the digital content or service, and not the date of its appearance. The legal warranty of conformity implies an obligation on the part of the professional, where applicable, to provide all updates necessary to maintain the conformity of the good.
The legal warranty of conformity entitles the Customer to repair or replacement of the good within thirty (30) days of his request, free of charge and without any major inconvenience for him. If the good is repaired under the legal warranty of conformity, the Customer benefits from a six (6) month extension of the initial warranty.
If the Customer asks for the good to be repaired, but the seller requires it to be replaced, the legal warranty of conformity is renewed for a period of two (2) years from the date of replacement of the good.
The customer may obtain a reduction in the purchase price by keeping the good, or terminate the contract by obtaining a full refund against return of the good, if :
- The professional refuses to repair or replace the good;
- The goods are repaired or replaced after a period of thirty (30) days;
- The repair or replacement of the good causes a major inconvenience for the Customer, in particular when the consumer definitively bears the costs of taking back or removing the non-conforming good, or if he bears the costs of installing the repaired or replacement good;
- The non-conformity of the good persists despite the seller's unsuccessful attempt to bring it into conformity.
The Customer is also entitled to a reduction in the price of the goods or to rescission of the contract if the lack of conformity is so serious as to justify immediate reduction in the price or rescission of the contract. In such cases, the Customer is not obliged to request repair or replacement of the goods beforehand.
The Customer is not entitled to rescind the contract if the lack of conformity is minor.
Any period of immobilization of the good with a view to its repair or replacement suspends the warranty which remained in force until the delivery of the reconditioned good.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.
Any seller who obstructs the implementation of the legal warranty of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual sales (article L. 241-5 of the French Consumer Code).
10.3 Legal warranty against hidden defects
The legal warranty against hidden defects applies under the following conditions:
- The defect was hidden and therefore not apparent at the time of purchase,
- The defect existed at the date of purchase,
- The defect renders the Product unusable or significantly reduces its usefulness.
The Customer benefits from the legal warranty for hidden defects in application of articles 1641 to 1649 of the French Civil Code, for a period of two (2) years from the discovery of the defect.
This warranty entitles the Customer to a price reduction if the good is kept, or to a full refund in exchange for the return of the good.
11. Legal information
Personal information relating to the customer is essential for the processing and delivery of orders and the preparation of invoices. Failure to provide this information will result in the order not being validated. In accordance with the French Data Protection Act (Loi Informatique et Libertés), the processing of nominative customer data has been declared to the French Data Protection Authority (Commission Nationale de l'Informatique et des Libertés - CNIL). The customer has the right to access, modify, rectify and delete data concerning him/her (article 34 of the law of January 6th 1978), which he/she can exercise by contacting piecesbateaux.com. In addition, piecesbateaux.com undertakes not to communicate, free of charge or in exchange for payment, the contact details of its customers to a third party. 12. Commitment to data protection
In accordance with the provisions of law no. 98-536 of July 1, 1998, transposing into the French intellectual property code directive 96/9/CE of March 11, 1996, concerning the legal protection of databases, piecesbateaux.com is the producer and owner of all or part of the databases making up the present site. By accessing the present site, the customer acknowledges that the data making it up is legally protected, and, in accordance with the provisions of the aforementioned law of July 1st 1998, refrains from extracting, reusing, storing, reproducing, representing or conserving, directly or indirectly, on any type of support, by any means and in any form whatsoever, all or part, qualitatively or quantitatively substantial, of the content of the databases appearing on the site to which he/she is accessing.
13. Reimbursement of VAT
Subject to eligibility, we can refund VAT on orders sent to a military base (Hub Armées), if the address is outside Europe. Please note that we will refund VAT on condition that you provide us with proof of export of the items (export document from French customs or import document from customs in the destination country). This also applies to orders shipped from France to a forwarding agent but destined for a customer living abroad.
